1. Long Term suspension or expulsion is determined to be necessary.

1.1. Long term suspension may be for up to 45 school days, without regard to manifestation, for following behaviors that take place at school or school function

1.1.1. 1. Possessing a gun or dangerous weapon

1.1.2. 2. Knowingly possessing, using or selling illegal drugs

1.1.3. 3. Inflicting serious bodily injury to another person

1.1.4. 4. A hearing officer determines that the child would pose a significant danger to themselves or others if they remain in the current placement

1.2. More than a 10 day suspension in the school year and the child must be provided with services for any additional days of removal.

1.2.1. Child should still make progress in general curriculum and progress toward meeting IEP goals

1.2.2. FBA must be conducted at this point if it has not already been done.

1.3. More than 10 days at a time, or a pattern of suspensions totaling more than 10 days are considered a change in placement.

1.3.1. IEP team must meet to determine if the behavior is a manifestation of the child's disability

1.3.2. Parents, representative of school district and other relevant members of child's IEP Team meet to discuss a revision of IEP or placement to meet child's needs

1.3.3. Parents must be given 5 day notice of a manifestation determination meeting

1.3.3.1. Parents must be given a copy of the procedural safeguards notice at this meeting
