Track Allocation - Three Tracks (County Court and High Court) 作者: Mind Map: Track Allocation - Three Tracks (County Court and High Court)

1. Multi-track

2. Fast track

2.1. Cases allocated to fast track due to being of public interest or legal significance could be directed to High Court Judge and so be partly managed as though allocated to multi-track.

3. most County Court cases will follow small claims track or fast track procedure

3.1. means they are dealt with more simply and quickly

4. Track allocated by procedural judge

5. Small claims track

5.1. allocated by District Judge who takes into account value of case and complexity

5.1.1. Judge me elect to allocate a complicated case to another track for a full hearing

5.2. claim less than £10,000

5.2.1. personal injury claim will only be allocated small claims track where financial value is less than £10,000 AND the value of the claim for the injury itself is less than £1000

5.2.2. residential tenant claiming against landlord for repairs where cost of repairs is less than £1000 AND claim for other damages is less than £1000

5.3. claim for remedy for harassments or unlawful eviction in relation to residential premises will NOT be allocated to small claims track regardless of financial value of the claim

5.4. case involving disputed allegation of dishonesty will not usually be suitable for small claims track

6. Although County Court has jurisdiction to hear multi-track, cases in High Court are exclusively multi-track
