Exempt Entities and\nProcurements-CRS §24-101-105

\n\n

Procurement Code applies to all publicly funded\nContracts entered into by all governmental bodies of the State executive\nbranch, with the exception of:

\n\n

i) Highway and bridge construction;

\n\n

ii) Contracts where public funds are not expended (includes\nRevenue-generating Contracts);

\n\n

iii) Grant specified Contracts, i.e., Contracts where the\nVendor is specified in the Grant or gift, unless the Grantor requires that\nState Procurement Rules apply;

\n\n

iv) Procurements by Legislative and Judicial Branches and\nthe four elected officials in the Executive Branch: Governor, Treasurer,\nSecretary of State, and Attorney General. This exemption is personal to the\nelected official and may not be used by departments, offices, or Agencies under\ntheir direction;

\n\n

v) Contracts for Professional Services (Ex. architects,\nengineers, surveyors, landscape architects, and industrial hygienists). Although exempt from\nthe Procurement Code, competition for such Services must be conducted through the\nuse of a Request for Statements of Qualification (RFQ) per CRS §24-30-1403. RFQs\nare published on BIDS and Advertised in at least one daily newspaper of general\ncirculation. Price cannot be used as a consideration in the Award (see Chapter\nIII.4(H), Statements of Qualification/ Request for Qualifications (RFQ));

\n\n

vi) Items bought for resale to the public as determined in\nwriting by heads of Agencies/IHEs Purchasing offices;

\n\n

vii) Intergovernmental purchases, (i.e. another State Agency\nor IHE, political sub-divisions, federal government agencies, counties, cities,\nother states, or foreign countries);

\n\n

viii) Law specified, i.e., Procurements where Vendor\nselection criteria are specified in law);

\n\n

ix) Public printing (excepting Remedies under CRS §24-109),\nwhich is covered by CRS Title 24, Article 70, Part 2, Public Printing. The SPO\nhas oversight Jurisdiction for the purchase of public printing under CRS\n§24-70-202;
