1. 4. Applying Fair Use to New Technologies

1.1. People have tried to develop new criteria and guidelines on what is considered to be fair use with our new technology, but no one can decide and agree on a good set of rules.

1.2. In a school system, after a student or students have created their own work of art, two copies can be made; one for the student an done for the school library.

2. 1. Copyrights and Copying Wrongs

2.1. According to Dictionary.com, it is "the legal right granted to an author, a composer, a play write, a publisher, or a distributor to exclusive publication, production, sale, or distribution of literary, musical, dramatic or artistic work."

3. 5. District Liability and Teaching Responsibilities

3.1. Districts are liable for teachers who have copyrighted. Companies, however, don't like to sue schools unless serious issues are brought up.

3.2. Teachers need to provide information on what copyright is and how it can effect them. They also must teach about plagiarism and the value of created works and how to cite and request permission to use others works.

4. 2. Is Fair Use a License to Steal?

4.1. "When in doubt, ask permission"

4.2. Materials that fall under fair use, don't need to have permission in order to use them.

4.3. There are four criteria that prove that is is fair use: 1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes. 2. the nature of the copyrighted work. 3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole. 4. the effect of the use upon the potential market for or value of the copyrighted work.

5. 3. Copyright Law and New Technologies

5.1. The guidelines for then pubic domains predate all of our new technology that we use in schools now days.

5.2. "The internet is NOT in the public domain."

5.3. Copyright was put into place so that the creator would get they money and worth out of their product. If someone uses their work but doesn't lose money for the owner, often times would not get charged with copyright, but may get a name for having bad "manners."
