Student Falling under IDEA protection violates school rules or policy

1. Removal Period of violation is 10 days of less

1.1. No change of placement is needed

2. Removal Period of violation is greater than 10 cummulative days

2.1. Parents must receive a copy of the procedural safeguards notice

2.1.1. IEP meeting is held with 10 days of decision

2.1.1.1. Must decide if the student's violation is a manifestation of their disability

2.1.1.1.1. Student's violation WAS a manifestation of their disability

2.1.1.1.2. Students violation WAS NOT a manifestation of their disability

2.1.1.1.3. During removal the IEP team must conduct a functional behavioral analysis and a positive behavioral intervention plan.

2.1.1.1.4. Student's violation falls under the "special circumstances"
