5. Property Offences

5.1. Stealing

5.1.1. Taking something without consent with an intention to (permanently or temporarily) deprive the owner of property. In such a case, the onus is on the crown to prove who the owner is.

5.2. Robbery

5.2.1. Any person who steals something and at the time of stealing it, or immediately after, uses or threatens to use violence in order to obtain it.

5.3. Break and Enter

5.3.1. Occurs when a person enters a building of which they are not the owner or tenant by means of unlocking, pulling or pushing. A person is said to have entered a building as soon as any part of the offenders body or any instrument they may have been using is within the building.

5.4. Burglary

5.4.1. Any person who is in the dwelling house of another with an intent to commit an indictable offence between the hours of 6pm and 6am is said to have committed burglary. ie. Break & enter and between 6pm and 6am.

5.5. Receiving

5.5.1. Receiving property knowing, believing or suspecting that it has been obtained by means of an indictable offence – usually stealing/robbery. Only need to prove that person has ’reason to believe’ the goods were stolen.

5.6. Arson

5.6.1. 4 element must exist: 1. Wilfully – deliberate, intentionally or recklessly 2. Unlawfully – without owners consent 3. Sets fire to 4. Things – buildings, vessels, crops cars, aircraft

5.7. Computer Hacking & Misuse

5.7.1. To use a computer without the consent of the computers controller

5.8. Faud

5.8.1. Essentially deals with dishonest conduct in regard to property Conduct is dishonest if ‘standards of ordinary persons in community would consider act dishonest’

5.9. Willful Damage

5.9.1. 4 element must exist: 1. Wilfully – deliberate, intentionally or recklessly 2. Unlawfully – without owners consent 3. Damages or destroys – includes graffiti 4. Property of another
