Terms and conditions of participation in the competition #ThisIsOurYear

1. Subject

1.1 These terms regulate the conditions for participation in the competition as well as any necessary transfer of rights. The description and the procedure of the respective competition are carried out within the framework of the respective competition.

1.2 The organizer of the competition is MeisterLabs GmbH, Zugspitzstrasse 2, 85591 Vaterstetten, Germany.

1.3 By participating in the respective competition, these terms and conditions of participation are accepted.

2. Participation

2.1 Anyone who has reached the age of 18 and has a MindMeister account is eligible to enter the competition. Employees of MeisterLabs GmbH and its subsidiaries as well as the relatives (fiancées, spouses or life partners, partners living in the same household, relatives and in-laws in a direct line, siblings, spouses/life partners of siblings, foster parents and foster children) of such employees are excluded and ineligible to win a prize. Participation with forged identities or with identities of third parties is not permitted.

2.2 Eligible participants can enter the competition by completing the mind map template, available at https://www.mindmeister.com/map/2533912832 (English) or https://www.mindmeister.com/map/2538462019 (German) and publishing the completed mind map using the hashtag #ThisIsOurYear during the competition period. An instruction of how to publish the mind map can be found in the mind map template. The publication is required for participation in the competition. The participant acknowledges and agrees that with the publication the mind map and the name or username of the participant are publicly available (via www.mindmeister.com/pages/this-is-our-year​/, www.mindmeister.com/pages/de/this-is-our-year​/ and https://www.mindmeister.com/mind-map-examples).  

2.3 Participation in the competition is possible from 09.01.2023 to 17.02.2023 (competition period).

3. Prize and prize notification

3.1 Among all eligible participants, a total of 3 business subscriptions to the MindMeister product with a term of 12 months each and a maximum number of 10 business licenses per subscription will be given away.

3.2 The winners will be selected by a jury from all eligible participants within one week of the closing date. The composition of the jury is determined by the organizer at its own discretion.  Winners will be notified of their win via email to the email address associated with their respective MindMeister account. Winners have to confirm the win within 7 days of receiving the notification email.

3.3 If a winner does not confirm the win within the specified period, the claim to the prize will expire. In this case, we are entitled to conduct a substitute draw.

3.4 Only one prize is possible per participant.

3.5 The prize is not transferable, nor can the prize be exchanged or paid out in cash.

4. Granting of usage rights and consent to publish the winner’s name

4.1 The participant guarantees to be the owner of the necessary rights to all uploaded, published or linked content. If the participant is not the sole author or rights holder, he expressly declares that he has the rights required for participation in the competition.

4.2 The participant grants us the following non-exclusive, perpetual, worldwide rights to use the content (mind map) used by him/her:

a. the right to store the content on a server;

b. the right to make the content available to the public in whole or in part via Facebook (Meta), LinkedIn, YouTube, Twitter, Instagram (Meta) and our websites

c. the right to use the content to promote our products.

4.3 When using the content (mindmap), we will identify the author in a suitable manner, insofar as this is feasible taking into account the specific form of use.

4.4 By accepting the prize, the winner agrees that we may use his or her name for advertising purposes and in the context of reporting about the competition on our websites (‘www.meisterlabs.com’, ‘www.mindmeister.com’, ‘www.meistertask.com’, ‘www.meisternote.com’, ‘community.meister.co’) and our social media profiles (Facebook (Meta), Instagram (Meta), YouTube, Twitter, LinkedIn).

5. Liability and indemnification

5.1 If the participant uploads content, the participant guarantees that he will not send any content whose provision, publication or use violates applicable law or the rights of third parties.

5.2 The participant indemnifies us against claims of third parties of any kind whatsoever resulting from the illegality of content used by the participant. The indemnification obligation also includes the obligation to fully indemnify the organizer from legal defense costs (e.g. court and attorney fees).

6. Exclusion

6.1 A violation of these terms and conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if the content used violates applicable law or the rights of third parties.

6.2 If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.

7. Termination and changes

We reserve the right to prematurely terminate the competition in whole or in part at any time, even without observing deadlines, or to change its course, in  particular if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to guarantee proper implementation of the competition.

8. Data protection

We are responsible for the collection, processing and use of participants’ personal data, insofar as we process this data ourselves. We will use the participant’s personal information and other personal data only within the framework of the statutory provisions of data protection law. We will only store, process and use the information to the extent that this is necessary for the implementation of the competition or if the participant has given his/her consent. This also includes the use for exercising the rights of use granted. The data will only be used to carry out the competition and will be deleted afterwards. The participant can request information about the data stored about him or her at any time.

9. Final provisions

9.1 Should the terms and conditions of participation contain invalid provisions, the validity of the remaining conditions shall remain unaffected.

9.2 German law shall apply to the exclusion of international private law. Mandatory consumer law provisions of the country in which the participant usually resides shall remain unaffected by the choice of law.

9.3 There is no right of appeal.

1. Who is responsible for data processing?

MeisterLabs GmbH, Zugspitzstrasse 2, 85591 Vaterstetten, Germany is responsible for processing your personal data when participating in competitions. In case of questions regarding this data protection information or to exercise your rights, please contact us by e-mail: privacy@meisterlabs.com 

2. Which categories of personal data are being processed?

The following personal data is processed in order to carry out the competition: First and last name, username, e-mail address, competition content (mind map), date of participation.

3. For what purposes or on what legal basis is personal data processed? Is personal data transmitted to third parties?

We process your personal data to carry out pre-contractual measures or to fulfill contractual obligations pursuant to Art. 6 (1) lit. b GDPR. The purpose of the processing is the implementation and execution of the competition as well as all related activities, such as the determination of the winners, the notification of the winners as well as the prize distribution. Please note that your published competition content (mind map) including your name or username is publicly available on the Internet (see the terms and conditions, point 2.).

In case of a win, we process and publish your name (along with the mind map published for the competition) for marketing purposes on our websites and/or our social media profiles on the basis of our overriding legitimate interest in reporting and documenting the competition pursuant to Art. 6 (1) lit f GDPR as well as on the basis of your consent pursuant to Art. 6 (1) lit a GDPR (see the terms and conditions, clauses 4.) You can revoke your consent at any time by sending a message to the e-mail address specified under point 1. The revocation of consent does not affect the legality of the data processed on the basis of given consent until revocation.

Further processing of your data will only take place if you have given your consent to this (for example, to receive information about our products and services). 

The data may be transferred to our IT service providers (hosting, e-mail provider in terms of e-mail notification about the win). No further data is transferred to other third parties for the purpose of processing the competition.

4. How long do we store your personal data?

Your personal data will only be processed and stored as long as this is necessary for the fulfillment of our contractual or legal obligations, i.e. in particular for the duration of the competition or beyond this also due to legal retention obligations. In addition, we process your data as long as this is necessary to defend against any claims (under the title of damages or warranty) or limitation periods of potential legal claims have not yet expired. The competition content (mindmap) will not be deleted by us and will continue to exist after the end of the competition, they are part of the MindMeister account and can be administered (deleted, edited) by the participant himself.

5. Your rights in connection with your personal data

Under applicable law, you have, among others, the rights: a) to check whether and what kind of personal data we hold about you and to request copies of such data (right of access); b) to request correction, supplementation or deletion of your personal data that is inaccurate or processed in non-compliance with the applicable requirements (right to rectification); c) request us to restrict the processing of your personal data (right to restriction of processing); d) in certain circumstances, to object for legitimate reasons to the processing of your personal data or to revoke consent previously granted for the processing (right to object); e) to request data portability; f) lodge a complaint with the competent authority.
